I used a finance company for 4 years to fund my transactions of those who needed lawsuit cash advance loans on their cases. They were great. yes we had our ups and downs as does every business but for the most part they were great.

I helped a friend get started in the lawsuit cash advance business and strongly recommended that they use this funder. They followed suit and in their first year they turned in a million dollars worth of fundings! They nailed it. I was very proud of the friend as they did 4 times what i did in my best year with 4 years under my belt.

The funder never thanked me, sent me a card, nothing.

If I gave you a million dollar referral, would you do me the same way?

Needless to say and it took way too long to realize, but I have severed the ties with this low class company. If anyone from that low class company is reading this post make mental note: Please and Thank You are basic manners in this society. If you don’t use them, then you are not entitled to grace.

Let me guess. You tried and tried to hold out but the bills kept coming in. You thought maybe your settlement would come in faster. You borrowed from family members. You depleted your savings. Then one day in all of your frustration, you saw an ad on tv, or was it the Thrifty Nickel? The Flyer? The Greensheet? Was it one of those free papers? And let me guess again, all the ads basically said the same thing. You couldn’t tell them apart and maybe if you took the time to call them all they might be the same person or funding company? The TV showed someone who is trustworthy telling you that an advance on your settlement is one phone call away. CASH IN 24 HRS! Could this be real? Is there really a way out of this hell hole that the personal injury lawsuit has put me through?

In your curiosity you call the number and immediately a person on the other end begins the interrogation. They are asking you for your personal data. You answer all of their questions because the pain of what you are going through has pushed you to the point that you are willing to do anything within reason to get some money now to ease your pain. They now tell you a different time line than what the ad says. But you are desperate so you hang on out of faith. A week goes by. They don’t call to update you. You call them and keep getting different people. “Why is this happening” you ask yourself? Am I being scammed? Should I have done this? Why didn’t my attorney tell me about this? Why is it taking so long? You start to panic even more.

You finally get the answer from one of the people at the funding company: “Your attorney isn’t cooperating”. Out of anger and desperation you call your attorney who doesn’t take your call. You scream at the paralegal instead. Week 3 arrives and they finally are getting somewhere! You get your lawsuit cash advance but before you do you look at the contract and the rates are different than what they told it would be!! You look at year 2 or 3 at the amount you would have to pay back and you get sick at your stomach that people could charge so much and not go to jail! You feel sick but at least are closer to the money now. Your problems in life will be delayed by this. You will have temporary relief or at least until your case settles.

BUT, after all of the frustration, suffering, pain, upset, anguish, rejection, family arguments over money, low morale, fighting with your attorney, etc. you submit and say “SCREW IT”! You sign it and get your money. You feel even sicker. None of it felt right.

Then you read a blog like mine and wonder if any of that could have been different.

Whomever said “what you don’t know can’t hurt you” wanted you to get hurt. In business as in personal matters it is not true. I have always said that the more you know the more control you have.

The Need for Lawsuit Loans is on the Rise!

2009 has seen a new rise for brokers who offer lawsuit loans. My phone is continually ringing! Now, more than ever it is important for you - the plaintiff of a personal injury settlement to weigh your options when trying to get a lawsuit loan.

I have many posts on this subject - how to select the right lawsuit loan broker, but here is the ESPN version:

1. Brokers get paid to get get you the best deal possible or they are not competitive. They also get a commission 5 days after you get your advance, therefore they are motivated to move FAST for you.

2. National companies, or going to direct to a company places you at a disadvantage. They only have one deal for you, Take it or leave it. They bank on the fact that you are desperate and will take their deal. The person at the company doesn’t live solely on commission. They earn an hourly rate no matter how fast you get your money so they operate slower than what you will experience with a broker.

I have been doing lawsuit funding as a broker now for 4.5 years. It is very interesting to take a look back and see what the numbers look like. For instance, 80% of the motor vehicle lawsuit cash advances that I have funded the plaintiff was hit while either at a red light or a stop sign!

Makes you a little uneasy if you think about it. What the hell are people doing as they approach a stop? But then again, most people aren’t consciously driving their vehicle.

99% of the lawsuits that receive funding through my office are motor vehicle accidents.
Part of the remaining 1% is the slip and fall. I usually instantly decline these because they are so difficult to fund. The reason is the liability is so difficult to prove. Their usually is a lack of documentation to support it as well. The damages are usually low - meaning the person rarely has even a herniated disk.

Another part of the remaining 1% is the medical malpractice lawsuit. Again, very difficult to fund because of liability reasons. But as far as damages it is much different than the slip and fall. They are usually very serious.

The final remaining part of the 1% is the workers compensation case. Only few states even allow lawsuit cash advances to be drawn on this type of case which makes it a low performer.

Most websites including mine list more than a dozen different case types that they can fund, but usually decline. That has been the experience through my office. A person told me the other day he called on once of the companies that does lawsuit funding on a commercial case - breach of contract because they listed it on their website and he was told that they don’t do those. He asked them why they have it listed on their website and they didn’t have an answer. IT WAS FOR SEARCH ENGINE REASONS ONLY.

So, ignore the big list of case types I fund. Yes, I am glad to always try and see if we can get you a lawsuit cash advance, but after reading this post you would be mistaken to bank on the fact that you could get lawsuit funding for most cases outside of the 4 I listed above and I don’t want you to get excited to only have your hopes crushed.

Using Craigslist to find people who need lawsuit cash advances. by Rob Thomas

Used to you would only find this many options for lawsuit funding in the cheap free papers i.e. The Flyer, Pennysaver, Thrifty Nickel, The Greensheet, etc. the ads would read: “In a lawsuit? Injured? Need cash now? Call 123-456-7890″. This is changing month after month. More and more individuals are finding Craigslist to be a good source for settlement funding.

Having a choice is a great thing. Knowing how to select the right person to give you a lawsuit advance is even better.
