For 5 years I have always wanted to help as many people as possible.

Lately, I am finding that trying to build a nationwide presence doing what I do is frustrating and very low pay.

I have found that most law firms do not send documents that are needed to get the case evaluated because the plaintiff - maybe this is also you, has applied to 15 different companies. This sucks for everyone when this happens. For the plaintiff, they have exposed their risk to getting the worst deal and they are essentially telling the universe, “I will take any offer, hurry!” It sucks for the paralegal because he or she send out the same documents to 15 different people who have different requests when she didn’t even want to do 1 of them. It sucks for the attorney because they have to have 15 different conversations for 1 plaintiff. It sucks for the funders because they all do the work and only one gets paid.

I have been receiving referral from many firms since 2004. After my recent experience of trying to “get it all” by going nationwide and receiving leads from the biggest rainmaker on the internet, I have decided that I like working with referrals from law firms only.

The documents arrive within 24 hrs of receiving the referral. The plaintiff already knows they are getting the best deal and great service so they are patient and ALLOW me to do what I do best. They are always happy and so are the firms that regularly use me otherwise they wouldn’t recommend me.

Does your law firm need a trustworthy source to make sure their clients get serviced and not ripped off?

Let me guess. You tried and tried to hold out but the bills kept coming in. You thought maybe your settlement would come in faster. You borrowed from family members. You depleted your savings. You took odd jobs. You starved yourself. You cut back on basic purchases. You told the kids no AGAIN and they are mad at you. You can’t go back to work because not only have you been directed to stay home by the lawyer but also the doctor. No one will hire you because you are now damaged goods and a screaming workman’s compensation liability waiting to happen.

Then one day in all of your frustration, you saw an ad on tv, or was it the Thrifty Nickel? The Flyer? The Greensheet? Was it one of those free papers? And let me guess again, all the ads basically said the same thing. You couldn’t tell them apart and maybe if you took the time to call them all they might be the same person or funding company? The TV showed someone who is trustworthy telling you that an advance on your settlement is one phone call away. CASH IN 24 HRS! Could this be real? Is there really a way out of this hell hole that the personal injury lawsuit has put me through?

In your curiosity you call the number and immediately a person on the other end begins the interrogation. They are asking you for your personal data. You answer all of their questions because the pain of what you are going through has pushed you to the point that you are willing to do anything within reason to get some money now to ease your pain. They now tell you a different time line than what the ad says. But you are desperate so you hang on out of faith. A week goes by. They don’t call to update you. You call them and keep getting different people. “Why is this happening” you ask yourself? Am I being scammed? Should I have done this? Why didn’t my attorney tell me about this? Why is it taking so long? You start to panic even more.

You finally get the answer from one of the people at the funding company: “Your attorney isn’t cooperating”. Out of anger and desperation you call your attorney who doesn’t take your call. You scream at the paralegal instead. Week 3 arrives and they finally are getting somewhere! You get your lawsuit cash advance but before you do you look at the contract and the rates are different than what they told it would be!! You look at year 2 or 3 at the amount you would have to pay back and you get sick at your stomach that people could charge so much and not go to jail! You feel sick but at least are closer to the money now. Your problems in life will be delayed by this. You will have temporary relief or at least until your case settles.

BUT, after all of the frustration, suffering, pain, upset, anguish, rejection, family arguments over money, low morale, fighting with your attorney, etc. you submit and say “SCREW IT”! You sign it and get your money. You feel even sicker. None of it felt right.

Then you read a blog like mine and wonder if any of that could have been different.

Whomever said “what you don’t know can’t hurt you” wanted you to get hurt. In business as in personal matters it is not true. I have always said that the more you know the more control you have.

Look at the other lawsuit loan funders. Do they have real pictures on there or something that the web designer used? Do you feel that you know them by visiting their website? Does it make you say, “I can trust this guy/gal”? Do they tell all regarding rates and what you actually have to do to get the lawsuit loan? Are they real in their time estimates?

The Need for Lawsuit Loans is on the Rise!

2009 has seen a new rise for brokers who offer lawsuit loans. My phone is continually ringing! Now, more than ever it is important for you - the plaintiff of a personal injury settlement to weigh your options when trying to get a lawsuit loan.

I have many posts on this subject - how to select the right lawsuit loan broker, but here is the ESPN version:

1. Brokers get paid to get get you the best deal possible or they are not competitive. They also get a commission 5 days after you get your advance, therefore they are motivated to move FAST for you.

2. National companies, or going to direct to a company places you at a disadvantage. They only have one deal for you, Take it or leave it. They bank on the fact that you are desperate and will take their deal. The person at the company doesn’t live solely on commission. They earn an hourly rate no matter how fast you get your money so they operate slower than what you will experience with a broker.

Today you will see many options for lawsuit advance/lawsuit cash advance. Used to you would only find this many options for lawsuit funding in the cheap free papers i.e. The Flyer, Pennysaver, Thrifty Nickel, The Greensheet, etc. the ads would read: “In a lawsuit? Injured? Need cash now? Call 123-456-7890″. This is changing month after month. More and more individuals are finding Craigslist to be a good source for settlement funding.

Having a choice is a great thing. Knowing how to select the right person to give you a lawsuit advance is even better. I have written an article on what to ask when selecting a lawsuit funding broker. I do not advocate going directly to a company. Use a broker, their job is to get you the best deal and you usually pay nothing for their service. You can use the article to gain more control over the lawsuit cash advance process.

Ok, I gotta say it only because I am hearing this from so many people who call me and tell me how they are being treated in this world we call lawsuit funding.

If you call a lawsuit funding source directly or whether you call a broker to get your lawsuit cash advance and all they do is try and “corral you into an app” by asking you for your name, address, etc. stop them in their tracks and tell them, “You arent getting another question answered by me, as a matter of fact, I have questions for you…..” See my other blog under the “lawsuit cash advance” category on what to ask. It is very important that you know this otherwise, you lack control of the process. Want more control? Know more. That which you don’t know CAN harm you. Whoever it was that said it couldn’t was a moron.

Recently I gained a client thanks to a funding source that starts with a “P” because they lied to them and told them when they called in “we can get 10k on this”. There is no way that “P” would know without looking at documents first. The client hadn’t even given them an aplication yet. But they didn’t know and trusted them. Needless to say they didn’t get my client the 10k (much less actually) and my client is willing to pay a little more in interest to switch to me because I was honest with them.

There is always someone out there who was meant to serve you. Truth trumps everything.

Don’t be the victim. Knowledge equals the opportunity for more control. Now that you know, exert control!
